The Fed just exposed the GENIUS Act's blind spot

Here's a question for every stablecoin holder: what good is a perfectly safe dollar claim if you can't move it when you need to?
The Fed just published a staff paper that answers that question in uncomfortable detail. “The Fragility of Perfectly Safe Digital Money,” first dated June 2, 2026, shows how a stablecoin with 100% safe reserves can still face a run. Not because the backing is shaky. Because the network is congested.
The mechanism matters
The GENIUS Act, Washington's new federal framework for payment stablecoins, focuses on reserves. Every issuer needs liquid assets backing every token. That's the right starting point. It's just not the whole story.
Here's what matters: the public blockchains carrying these tokens have their own fee markets and capacity limits. When traffic spikes, fees go up. When fees go up, holders start thinking about exit. When everyone thinks about exit at the same time, you get a classic bank run dynamic.
The Fed paper models this precisely. Weak network effects plus congestion can push holders toward redemptions or chain migration. The token is fine. The dollar backing is fine. But the bearer can't get out without paying a massive premium or switching networks entirely.
That's the fragility.
The GENIUS Act doesn't touch this
From a risk perspective, this is the gap in the legislation. The GENIUS Act sets reserve requirements, audit rules, and bankruptcy protections. It doesn't address network capacity, fee volatility, or what happens when millions of holders try to redeem simultaneously during a congestion event.
The reality is that a stablecoin is only as liquid as the blockchain it lives on. You can have the safest Treasury backing in the world. If the network is jammed, your exit is delayed. And in a panic, delay is everything.
So who's exposed? The biggest networks with the densest traffic are the most vulnerable to fee spikes. Smaller chains might offer cheaper exits but they've thinner liquidity and weaker network effects. That's the tradeoff the legislation doesn't acknowledge.
And it's not just retail holders. Institutional flows matter here too. If a money market fund or a treasury desk needs to rebalance out of a stablecoin position and the chain is congested, they're stuck paying whatever the fee market demands. That's not safe asset behavior.

The GENIUS Act creates an illusion of safety. Reserve transparency is necessary, but it's not sufficient. The bill treats the token as the product when the token plus the network is the actual product.
The numbers tell the story: a fully reserved stablecoin should never trade below $1. But if the mechanism to redeem or transfer is congested, the effective value to a holder in a hurry drops well below that. The Fed paper calls this out. Congress should be listening.
