FCA Sets Oct. 25, 2027 Deadline, and Offshore Crypto Has 14 Days to Map It
The FCA's final cryptoasset perimeter guidance says overseas platforms, custodians and staking providers fall under UK authorization when they serve British consumers. Applications open Sept. 30, and there's no automatic conversion for firms already registered.
The UK Financial Conduct Authority published its final cryptoasset perimeter guidance on Sept. 16, and the message to offshore operators is blunt. If you serve a British retail customer, you're likely inside the fence.
The new regulated cryptoasset activities enter the perimeter on Oct. 25, 2027. Applications for transitional arrangements open Sept. 30, 2026 and close Feb. 28, 2027. That leaves overseas platforms, custodians and staking providers less than two weeks from publication to map how UK consumers actually reach their services. There's no rescue clause either. Automatic conversion of existing registrations and permissions doesn't exist, so a firm already authorized may still need to vary its mandate when current scope omits the new activities.
Here's where it gets interesting. The FCA defines a "UK consumer" as an individual in the UK acting outside a trade, business or profession. That's a statutory territorial concept, and it doesn't line up neatly with client categories used elsewhere in the Handbook. The structure of the access matters more than the address of the provider.
Consider two outcomes for the same overseas trading platform. If it's unavailable to UK consumers and an authorized UK firm trades on it as principal, the operator stays outside the perimeter. If that same UK firm instead acts as agent for UK consumers, the operator needs authorization. Same platform, different capacity, different answer.
Staking and custody get activity-specific treatment. An overseas provider safeguarding crypto or arranging staking for a UK consumer can be deemed to operate in the UK when it acts independently of a person authorized for that activity. Act at the authorized person's direction and the arrangement falls outside that provision. Automated-protocol interfaces get assessed case by case, with the FCA asking whether an identifiable person carries on the regulated activity by way of business in the UK.
And none of this binds a court. PERG is the FCA's interpretation of legislation, not the legislation itself.
My read: this quietly shifts the balance toward UK-authorized intermediaries. They become the gatekeepers, and that's a position they can price. Wall Street is moving. Quietly.
