Democrats Own Congress and CLARITY Now Needs 60 Votes. The Price Is Consumer Protection.
The CLARITY Act cleared the House in July 2025 with 78 Democratic votes, and that coalition was always the bill's real asset. Now Democrats run both chambers, which makes consumer-protection and ethics language the entry fee for 60 Senate votes. Crypto's lobbying budget is due, and campaign checks won't cover it.
Democrats took both chambers in the 2026 midterms. For the CLARITY Act, that's the entire story, and it's not the story anyone long this bill wanted. The market-structure package cleared the House in July 2025 by 294 to 134, with 78 Democrats joining the majority. That cross-party coalition was always the real asset. Strip it out and the bill is a press release with a bill number attached.
The Senate still needs 60 votes. So the consumer-protection and ethics provisions Democrats have been drafting since last spring, token-disclosure standards, conflicts-of-interest limits on officials holding digital assets, tighter custody rules, stop being amendments. They become the price of admission. Crypto's campaign spending, which ran past $130 million in the 2024 cycle, didn't buy a friendly Congress this time.
Winners are easy to spot. Regulated US venues and custodians, the ones already spending eight figures a year on compliance staff, get a moat the moment the rules get written down. Losers are the offshore shops whose core product was regulatory arbitrage. They've had a good run on the ambiguity trade. It's ending either way, and everyone in the room knows it.
Here's my read. The industry should give ground fast on the parts that were never worth defending. Clear lines on which agency polices spot markets, the SEC or the CFTC, are worth more than the ambiguity anyone has been monetizing. Ambiguity costs legal fees and time preference, and both compound against you. The fights worth having are narrower. Whether stablecoin issuers can pass yield to holders. How DeFi protocols get treated when no single party holds the keys.
A weakened bill that limps into 2027 isn't a loss. It's a delay. And delays don't touch the monetary premium on a fixed-supply asset. Scarcity doesn't require a statute, and no markup schedule bends the arc of the thing.
Watch the Senate Banking Committee's first markup in the new session. This is a century bet, not a quarterly report.
